THE CORPORATION OF THE TOWNSHIP OF LAIRD
By-law Number 868-08
(Regarding Kennels)


Being a By-Law to regulate Kennels for the breeding of purebred dogs and Boarding Kennels within the Township of Laird.

The Council of the Corporation of the Township of Laird pursuant to the Municipal Act, 2001, enacts as follows:

1. INTERPRETATION:

In this By-Law:
(a) "Kennel" means an establishment where a kennel of purebred dogs is registered with the Canadian Kennel Club and bred under the owner's name.
(b) "Boarding Kennel" means any building or part thereof for the boarding of dogs.
(c) "Dog" shall mean a male or female dog.
(d) "Operator" includes owner or employee and each has the same responsibility for the care and well-being of the animals in the kennel.

2. PROHIBITION OF BOARDING KENNELS
No owner or operator shall establish a Boarding Kennel anywhere in the Township of Laird after the enactment of this By-Law.

3. CONSTRUCTION OF KENNELS
(a) All owners and operators shall construct buildings, including pens and cages, in compliance with the Building Code Act and municipal By-Laws.
(b) No building or part thereof including pen, cage or any other structure shall be located:
(i) Within 110 metres of a dwelling house on an abutting property;
(ii) Within 100 metres of the nearest property limit of the property on which it is located.

4. NIGHT TIME RESTRICTIONS
All owners and operators of a "kennel" or "boarding kennel" must keep all dogs inside a building from 9:00 p.m. to 7:00 a.m.

5. NOISE CONTROL
The owner or operator of a "kennel" or "Boarding Kennel" shall not permit:
(a) Persistent barking or whining or other persistent noise making by a dog under his or her care.
(b) Where three charges are laid under this section against the owner/operator of a "kennel" or "boarding kennel" resulting in convictions the "kennel" licence or "boarding kennel" licence shall be permanently revoked.

6. ANNUAL INSPECTION REPORT
All "kennel licensees" and "boarding kennel licensees" shall provide an annual inspection report of the premises by the Sault Ste. Marie and District Society for the Prevention of Cruelty to Animals indicating that approval of the "kennel" and "boarding kennel" with respect to the conditions of operation and quality of care for the dogs, and failing which, the annual "kennel" licence or "boarding kennel" licence shall not be issued. Arrangements for the inspection report and the cost of the report shall be paid by the applicant for the licence.

7. ANNUAL LICENCE
All owners or operators of a Kennel or Boarding Kennel who have complied with the terms of this By-Law and all other relevant municipal By-Laws, shall apply for and pay an annual licence fee of $100.00.

8. PENALTY
Any person who contravenes any of the provisions of this By-Law is guilty of an offence and is liable in accordance with the provisions of the Provincial Offences Act, as amended to a fine of $150.00 exclusive of costs for first offence.

9. BY-LAW REPEALED
By-Laws 654-88 and 867-07 of the Corporation of the Township of Laird are hereby repealed.

10. EFFECTIVE DATE
This By-Law comes into force on the date of its final passing.
