THE CORPORATION OF THE TOWNSHIP OF LAIRD
By-law Number 866-07
(Regarding Parking On Finns' Bay Road)


Being a by-law to regulate parking within the Township of Laird on a portion of Finns' Bay Road:­

WHEREAS the Municipal Act, 2001, Section 11.(3) and the Highway Traffic Act, R.S.O. 1990, c. H.8, Section 170, authorize the passing of by-laws respecting parking, to prohibit parking, standing or stopping of vehicles on roadways, for removing a vehicle, imposing a penalty and placing a lien on a vehicle contravening the By-law;

AND WHEREAS the Council of the Township of Laird deems it expedient to prohibit the parking of vehicles on a portion of Finns' Bay Road North;

THEREFORE the Council of the Township of Laird enacts as follows:


1. Definitions:
For the purpose of this By-Law:

"Park" or "Parking" when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.

"Street" or "Highway" includes a common or public highway, street, road, avenue, parkway, driveway, square, place, bridge, causeway, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles.

"Vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power.


2. Parking Regulations
a) When properly worded signs have been erected and are on display, no person shall park a vehicle on the street or highway, or parts thereof set out in column 1, on the sides set out in column 2, and between the limits set out in column 3, at any time in any year.

b) Any vehicle found contravening the provisions of this By-law may be moved by the Municipal Law Enforcement Officer, or the Municipal Law Enforcement Officer may require the driver, or operator or other person in charge of the vehicle to move it.

c) The Municipal Law Enforcement Officer, upon discovery of any vehicle parked or standing in contravention of this By-law, may cause it to be moved, or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle, which may be enforced in the manner provided by Section 52 of the Mechanics' Lien Act, R.S.O., 1980, Chapter 261, or any replacement legislation.


3. Penalties
Any person who contravenes any of the provisions of this By-law is guilty of an offence and on summary conviction is liable to a fine of not less than $25.00 and not more than $150.00 and the penalties imposed are recoverable under the Provincial Offences Act, R.S.O., 1980 Chapter 400, and amendments thereto, exclusive of costs.
